1. About KobStore
KobStore is an e-commerce platform incorporated in Kenya that enables sellers to create branded online storefronts and receive orders. By registering an account or using any KobStore service you agree to these Terms. If you do not agree, do not use the platform.
2. Accounts and eligibility
- You must be at least 18 years old to open a seller account.
- You are responsible for maintaining the security of your login credentials.
- One person may not operate multiple active seller accounts without written consent from KobStore.
- We reserve the right to refuse registration at our discretion.
3. Subscription plans and billing
KobStore offers tiered subscription plans. Plan details and current pricing are listed at kobstore.co.ke/pricing. All subscription payments are processed by our payments partner. You may pay by card or M-Pesa.
- Billing cycles: Monthly and annual billing cycles are available. Annual plans are offered at a discount versus monthly — see the pricing page for current rates.
- Auto-renewal: Plans renew automatically. You will receive a reminder before each renewal. Cancel auto-renewal at any time from Dashboard → Billing.
- Renewal reminders: You will receive a reminder before your subscription expires and again if a payment fails.
- Grace period: If a renewal payment fails or is not made, your storefront remains live for a short grace period before being paused until payment is received.
- No refunds: Subscription fees are non-refundable once a billing cycle begins, except where required by Kenyan consumer protection law.
- Upgrades: Upgrading takes effect immediately. You pay the difference for the remainder of your current cycle.
- Downgrades: Downgrades take effect at the start of the next billing cycle. Features of the higher plan remain available until the cycle ends.
4. Message bundles
Your subscription plan determines which messaging features are available. Messages sent on your behalf for marketing purposes are powered by purchased message credits (bundles), which are separate from your subscription.
- Free sends: Order notifications, verification codes, and system alerts (renewal reminders, payment confirmations) are sent at no credit cost to you.
- Paid sends: Follower broadcasts, win-back campaigns, and SMS campaigns consume message credits from your bundle balance.
- Bundle pricing: SMS and WhatsApp credit packs are available in multiple sizes. Current prices are shown at checkout.
- Credits do not expire and carry over between billing cycles. They are non-refundable once purchased.
- Insufficient credits: If your balance is too low for a broadcast, the send will be blocked and you will be prompted to top up.
5. Promoted listings
Sellers on any paid plan may pay to feature a product on the KobStore Explore page, making it appear above unsponsored listings during the promotion period.
- Promotion packages are available in weekly and monthly durations — current rates are shown at checkout.
- The promotion activates on confirmed payment.
- Promotion fees are non-refundable. If a product is deleted or unpublished during an active promotion period, no refund is issued.
- KobStore does not guarantee any specific number of views or sales from a promoted listing.
6. Seller verification
Sellers on paid plans may apply for a verified badge by submitting business documents for review. Verification is voluntary and confers a visible badge on your storefront.
- A one-time verification fee applies, tiered by plan — the current fee is shown at the point of application.
- The fee is paid before document submission.
- The fee is non-refundable regardless of the review outcome.
- KobStore reserves the right to revoke verification if a seller is found to have submitted false documents or violated these Terms.
7. Seller responsibilities
- You are solely responsible for the accuracy of all product descriptions, prices, images, and availability shown on your storefront.
- You must fulfil orders or enquiries received through your storefront promptly and honestly.
- You must comply with all applicable Kenyan laws, including the Consumer Protection Act, tax obligations, and sector-specific regulations (e.g. food handling for restaurant stores).
- You may not list counterfeit goods, prohibited substances, stolen property, or content that infringes intellectual property rights.
- KobStore is a platform provider — we are not the seller and bear no liability for the quality, legality, or delivery of goods or services listed by sellers.
8. Transactions between buyers and sellers
KobStore is a platform that connects buyers and sellers. All transactions — including payment, delivery, and any after-sale arrangements — are made directly between the buyer and the seller. KobStore does not hold, process, or transfer funds on behalf of any party, and is not responsible for the fulfilment of any order. Any disagreements regarding orders must be resolved directly between the buyer and seller. Parties retain the right to pursue remedies through the Kenyan court system independently.
9. Intellectual property
- You retain ownership of content you upload (product images, descriptions, blog posts).
- By uploading content you grant KobStore a non-exclusive, royalty-free licence to host, display, and distribute that content solely for operating your storefront.
- The KobStore brand, platform code, and design are owned by KobStore and may not be copied or reused without permission.
10. Prohibited uses
You may not use KobStore to:
- Sell illegal goods or services under Kenyan law
- Conduct phishing, fraud, or impersonation
- Spam buyers with unsolicited messages via the WhatsApp bot or SMS
- Attempt to circumvent subscription paywalls or access features above your plan
- Reverse-engineer, scrape, or copy the platform's source code or data
- List the same product under multiple accounts to manipulate market intelligence rankings
Violation may result in immediate account suspension without refund.
11. Limitation of liability
To the maximum extent permitted by Kenyan law, KobStore's total liability to any seller or buyer arising from these Terms shall not exceed the subscription fees paid by that seller in the 3 months preceding the claim. KobStore is not liable for lost profits, lost data, or indirect damages of any kind.
12. Termination
- By you: Cancel your subscription at any time from the Billing page. Your storefront remains active until the end of the paid cycle.
- By us: We may suspend or terminate accounts that breach these Terms, with or without notice depending on severity.
- Upon termination, your storefront is taken offline. We retain order records for 7 years as required by Kenyan tax law; all other data is deleted within 24 months.
- Unused message credits are forfeited on account termination and are not refundable.
13. Governing law
These Terms are governed by the laws of Kenya. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
14. Changes to these Terms
We will notify sellers via email at least 14 days before any material change. Continued use of KobStore after the effective date constitutes acceptance of the updated Terms.
